Ending a West Virginia tenancy
West Virginia § 37-6-5 allows termination of a periodic tenancy shorter than one year by written notice for one full period before a period ends. Year-to-year uses at least three months before the tenancy-year end. A definite term ordinarily ends without notice, and a special agreement can set a different notice requirement. W. Va. Code § 37-6-5
Use the actual agreed period boundary, not merely the payment due date.
Allow one full weekly or monthly period before its end.
Check special agreements, renewal clauses and definite terms.
Personally serve the tenant or a person holding the premises under the tenant and preserve evidence.
