Tenant left property behind in Utah
Utah distinguishes abandonment of the rental premises from disposition of belongings. The premises presumption requires specific rent, absence, and occupancy facts; a declaration has a 24-hour written dispute window excluding closed-court time. After lawful retaking, ordinary belongings require posting and first-class mailing with 15 calendar days to retrieve. Utah Code §§ 78B-6-815–816
Do not infer abandonment from a temporary absence alone.
A declaration under § 78B-6-815 has required factual and dispute wording.
Posted and mailed belongings notice under § 78B-6-816 starts a separate retrieval process.
Vehicles, animals, hazards, estates, other owners, extensions, and hearings need separate review.
