Tenant won't move out in South Dakota
Verify the tenancy ended, check later rent acceptance and lease prerequisites, and continue into South Dakota's current forcible-detainer process without reviving the repealed general notice statute.
Start the South Dakota decision toolStart with why the tenancy should already be over.
Verify the expiration or termination date has actually been reached.
Check whether rent was accepted after expiration, which can renew the hiring.
Check the lease for any contractual possession-demand requirement before court.
Why this matters
South Dakota treats holding over after termination or expiration as a forcible-detainer ground. The former statewide advance notice provision was repealed in 2024, but the tenancy still must actually have ended and the lease can still matter.
Legal authority: SDCL §§ 21-16-1(4), 21-16-2 (repealed), 43-32-14
What happens next
If the holdover ground is established and no contractual or special-law prerequisite remains, the next stage is the official South Dakota eviction filing process.
